Welcome to DashSharing ("we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our website www.DashSharing.com (the "Site") and services ("Services") that connect electric vehicle (EV) owners with residential charging stations across Canada. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Services.
1. Acceptance of Terms
By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
2. Eligibility
You must be at least 18 years old and capable of entering into legally binding agreements to use our Services. By using the Services, you represent and warrant that you meet these eligibility requirements.
3. Description of Services
DashSharing provides a platform that connects:

Hosts: Residential EV charging station owners willing to offer charging services.

EV Drivers: Individuals seeking accessible EV charging options.
We facilitate the booking and payment processes between Hosts and EV Drivers but are not a party to any agreements between them.
4. Account Registration
4.1 User Accounts
To access certain features of our Services, you must register for an account ("User Account") and provide accurate, current, and complete information.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.
5. User Obligations
5.1 Accurate Information
You agree to provide and maintain accurate, complete, and up-to-date information in your User Account.
5.2 Compliance with Laws
You must comply with all applicable federal, provincial, and local laws, regulations, and bylaws when using our Services.
5.3 Prohibited Conduct
You agree not to:

6. Host and EV Driver Responsibilities
6.1 Hosts

Insurance: Hosts are responsible for obtaining and maintaining appropriate insurance coverage for their charging stations.

Compliance: Hosts must ensure their charging stations comply with all safety standards and regulations.

Listing Accuracy: Hosts must provide accurate and complete information about their charging stations.
6.2 EV Drivers

Vehicle Compatibility: EV Drivers are responsible for ensuring their vehicle is compatible with the Host's charging station.

Payment Obligations: EV Drivers agree to pay all fees associated with the use of the Host's charging station as agreed upon at the time of booking.

Conduct: EV Drivers must respect the Host's property and adhere to any rules set forth by the Host.
7. Payments and Fees
7.1 Payment Processing
Payment transactions between Hosts and EV Drivers are facilitated through our third-party payment processor. By using our Services, you agree to comply with the payment processor's terms and conditions.
7.2 Service Fees
We may charge service fees to Hosts and/or EV Drivers for the use of our platform. All applicable fees will be displayed prior to booking or listing.
8. Carbon Credits
You acknowledge and agree that all carbon credits, environmental attributes, offsets, allowances, renewable energy certificates, or any similar marketable environmental benefits (collectively, "Carbon Credits") that are generated by, or are attributable to, the EV charging activities facilitated through the DashSharing platform are the sole and exclusive property of DashSharing. Hosts and EV Drivers hereby irrevocably assign and transfer any and all rights, title, and interest in such Carbon Credits to DashSharing. You agree not to pursue any claim, registration, or financial benefit from such Carbon Credits and will cooperate with DashSharing, at our expense, in securing and perfecting our rights to them.
9. Cancellation and Refunds
Cancellation policies may vary and will be specified at the time of booking. Any refunds are subject to the Host's cancellation policy and applicable service fees.
10. Intellectual Property Rights
10.1 DashSharing Content
We own all rights, title, and interest in the Site and Services, including text, graphics, software, and other content ("DashSharing Content"). You may not use, reproduce, or distribute DashSharing Content without our express written permission.
10.2 User Content
By posting content on our platform, you grant DashSharing a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with the Services.
11. Disclaimers

No Endorsement: DashSharing does not endorse any Users or guarantee the suitability, safety, or legality of any charging station.

No Warranty: The Services are provided "as is" without warranties of any kind, either express or implied.

Limitation of Liability: To the fullest extent permitted by law, DashSharing shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold harmless DashSharing, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of or relating to your use of the Services or violation of these Terms.
13. Termination
We may terminate or suspend your account and access to the Services at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the platform.
14. Governing Law
These Terms and any disputes arising out of or relating to them or the use of our Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
By accessing or using our Services, you agree to submit to the exclusive jurisdiction of the courts located within the Province of Ontario for the resolution of any disputes.
15. Dispute Resolution
Any disputes arising out of or relating to these Terms or the Services will be resolved through binding arbitration conducted in Ontario, Canada, in accordance with the Arbitration Act, 1991 (Ontario).
16. Changes to the Terms
We reserve the right to modify these Terms at any time. We will provide notice of changes by updating the "Effective Date" at the top of these Terms. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
17. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and DashSharing regarding the use of the Services.
